How Long do I have to File a Personal Injury Claim after a Car Accident?

If you were injured in a car accident in Pennsylvania, you typically have two years from the date of your injury to file a lawsuit against the responsible party.

There are, however, exceptions to the two-year deadline for personal injury cases. Pennsylvania’s personal injury statute of limitations stipulates that legal action must be filed within two years of the date when the injury occurred; this deadline may be extended based on when the injuries became evident.

Pennsylvania allows two years from the date of discovery of the injury, or the date when the injury should have been evident, for circumstances in which injuries do not immediately present symptoms.
