Premises Liability

Premises liability refers to injuries which occur because the property owner was negligent or created an unsafe condition. Land owners are required to protect those who enter their property lawfully.

These types of cases also include claims stemming from construction defects and personal injuries suffered due to faulty construction. An increasing number of property cases involve injuries caused by toxic mold. Modern building techniques make structures more susceptible to mold proliferation. Moisture can get sucked into the structure and remain there, spreading mold throughout the building.

We have successfully represented many victims of premises liability. In some cases, there may be many different people responsible for the property. Detailed investigation and analysis is required to ensure the correct defendants are identified. Since different defendants may be responsible for different errors, our creative presentation of cases has enabled our clients to obtain a more favorable recovery. For example, we represented the widow and estate of a 47 year old man who died as a result of a workplace injury. While worker’s compensation laws prevent suing one’s own employer, we obtained a substantial settlement with the property owner and, on top of that, obtained a $3.5 million verdict from a company hired to provide security guard services.
